ARTICLE 1
NAME

SECTION 1.  This organization shall be known as Amalgamated Local 892, International Union, United Automobile, Aerospace and Agricultural Implement Workers of America.   (04/25/92)

 ARTICLE 2
OBJECTS

SECTION 1.  This Local Union subscribes to the objectives set forth in the International Union Constitution, and further subscribes to increase public understanding of the labor movement, regardless of sex, race, creed, color or political affiliation or nationality.

ARTICLE 3
CONSTITUTION AND BY-LAWS

SECTION 1.  The constitution of this organization shall be the Constitution of the International Union, UAW, and these by-laws shall be in all respects subordinate to said constitution and all applications and interpretations thereof.

ARTICLE 4
JURISDICTION

SECTION 1.  The jurisdiction of Local 892, UAW, shall include all eligible employees of the Ford Motor Company’s Saline Plant and Total Fitness Concepts and any other companies or work sites assigned by the International Executive Board.   (04/05/97)

SECTION 2.  The headquarters shall be the Local 892, UAW Union Hall, 601 Woodland Drive, Saline, Michigan, 48176-1297, or as may be designated by the Local Union Executive Board, subject to the approval of the membership body.

ARTICLE 5
FISCAL YEAR

SECTION 1.  The fiscal year of this Local Union shall begin on January 1 and end on December 31.

ARTICLE 6
MEMBERSHIP

SECTION 1.  The Local Union shall be composed of workers eligible for membership in the International Union, United Automobile, Aerospace and Agricultural Implement Workers of America (UAW).

SECTION 2.  Each member in good standing of the Local Union has the right to nominate and vote, to express opinions on all subjects before the Local Union, to attend all membership meetings, to express views, arguments and opinions on all matters of business including candidates office, properly before the meeting. He/She shall have the right and obligation to meet and assemble freely with other workers, to participate in the activities of the Local Union in a responsible manner, consistent with good conscience, in order to present the issues and personalities upon which the membership must base its decisions. These rules and regulations are contained in the Constitution, By-Laws and other official rules of the Local Union. A member exercising the foregoing rights and privileges shall not take any irresponsible action which would tend to jeopardize, destroy or be detrimental to either the Local Union or the International Union as organizations, or their free democratic heritage, or which would interfere with the legal or contractual obligations of this affiliate of the International Union. Violation or abuse of these rights and privileges, or engaging in conduct prohibited by this section, shall be considered conduct unbecoming a Union Member.

SECTION 3.  The membership shall strive to obtain the objectives that are established as the policy of the International Union, to maintain free relations with other organizations, to do all in its power to strengthen and promote the labor movement, to co-operate with Regional Board Members, the International Representatives, Officers and fellow members of Local 892 and help promote organizational activities.

ARTICLE 7
MEMBERSHIP MEETINGS

SECTION 1.  Regular membership meetings shall be held at least once a month. This meeting shall be held at 10:00 a.m. on the last Saturday of the month. If a holiday falls on the last weekend of the month, the meeting will be held on the following Saturday, or if the membership or the Executive Board deems a change is necessary at a previous meeting.

A.      The December General Membership Meeting will automatically be combined with the January General Membership Meeting. (01/31/04)

B.    The June and July General Membership meetings will automatically be combined with the August       General Membership meeting. (04/30/05)

SECTION 2.  Special membership meetings may be held when deemed necessary by the Executive Board, or when called for by a majority vote of the members present and voting at the regular membership meeting.

SECTION 3.  Notices of regular membership or special membership meetings shall be posted on the plant and Local Union Hall bulletin boards at least seven (7) days before the meeting. (01/30/88)

A. Any change of the date or time of a regular membership meeting shall be posted at least seven (7) days before the regular membership meeting being changed.  (01/30/88)

SECTION 4.  In an extreme emergency, a special membership meeting may be called by the Executive Board if the agenda is posted on the bulletin boards for all shifts at least six (6) hours and the Local Union Officers verbally notify as many members as they are able to contact in their areas.

SECTION 5.  A special meeting may be called by petition which will require ten percent (10%) of the total hourly people in the plant on the date of the petition, based on the previous month’s per capita taxes. The above-mentioned petition will be presented to the President as soon as possible and the President shall have the agenda posted within twenty-four (24) hours and all Local Union Officers shall verbally notify as many persons as possible in the assigned areas.

SECTION 6.  Any member who attends a meeting in an intoxicated condition and/or creates a disturbance, or becomes unruly, shall lose voice and the right to vote at said meeting. Where necessary to maintain order, the member may be evicted from the meeting by order of the President, subject to the challenge of the membership.

Flagrant or persistent violation of this section by any member shall be considered conduct unbecoming a union member.

SECTION 7.  All questions of parliamentary nature will be governed by the revised “Robert’s Rules of Order”.

A. The President shall rule on all questions of order regarding parliamentary procedure.

SECTION 8.  All motions to purchase or enter into contracts shall be specific, including all costs and details. These motions shall be presented to the membership prior to any commitments made by any elected or appointed member of Local 892, UAW.

SECTION 9.  Skilled Trades Meetings will be held at least every six (6) months.

ARTICLE 8
POWERS OF ADMINISTRATION

SECTION 1.  The highest authority of the Local Union shall be vested in the regular membership meetings-PROVIDED NO ACTION IS TAKEN NOT CONSISTENT WITH THE CONSTITUTION OR THE LOCAL 892 BY-LAWS.

SECTION 2.  Between membership meetings, the Executive Board shall be the highest authority of the Local Union and shall meet as deemed necessary. They shall be empowered to act on behalf of the membership to the extent of urgent business that requires prompt and decisive action, subject to subsequent membership approval for any amount combined or otherwise that exceeds twenty-five hundred ($2500.00) dollars, but the Executive Board may not take action affecting the vital interest of the Local Union without prior membership approval. SECTION 3.  Between meetings of the Executive Board, the President shall exercise general administrative authority, subject to subsequent approval of the Executive Board. (09/30/89)

SECTION 4.  The Unit Bargaining Committee shall be comprised contractually of four (4) members:

 1. Elected Saline Ford Plant Chairman. (04/25/92)

 2. One (1) elected Skilled Trades Bargaining Committeeman.

 3. Two (2) elected Production Bargaining Committeemen.

The Plant Chairman, Bargaining Committee, District Committee and Alternate Committeemen shall be elected separately.  (01/26/91) 

The Alternate Committee shall be comprised of no more than ten (10) Production and three (3) Skilled Trades. Those receiving the highest number of votes for each office stand elected.  (03/26/95)

A. In the event of a vacancy or vacancies, existing from a resignation or long period medical leave or incapacitation of a Bargaining committeeman, the District Committeeman receiving the highest number of votes shall assume the position of Bargaining Committeeman. When the medical leave expires and upon the return of the Bargaining Committeeman, he shall resume his respective duties on the Bargaining Committee.

ARTICLE 9
OFFICERS

SECTION 1.  This Local Union shall have the following Executive Officers, who shall constitute the Executive Board:  (A) President,  (B) Vice-President, (C) Recording Secretary, (D) Financial-Secretary/Treasurer, (E) Chairman of the Trustees, (F) Two (2) Trustees (G) Sergeant-at-Arms, (H) Guide, (I) Retiree Chapter Member (an Executive Board Member “but not an Executive Officer”)  (Per International-03/17/99)

(J) Saline Ford Plant Chairman, and (K) Total Fitness Concepts Chairman. Both Chairpersons are Executive Board Members, but not Executive Officers.  (04/25/92)

ARTICLE 10
LOCAL PUBLICATION

 SECTION 1. This Local Union shall publish a Local paper, when the membership desires and approves it. (09/30/06)

SECTION 2.  The Chairman of the Publicity Committee shall be considered Editor of the Local paper and shall select the Committee to be a representative of the different shop areas as possible.

SECTION 3.  An Editorial Committee, appointed by the Executive Board, composed of one (1) member of the Executive Board, one (1) member of the In-Plant Committee and two (2) members from the Rank and File, shall take steps where necessary to bring the contents and the policy of the publication into conformity with the policy of the International Union. They shall be responsible for all articles published in the Local Union paper.

SECTION 4.  The Editor shall have all articles available for the Editorial Committee, three (3) days prior to the publishing date.

SECTION 5.  An allocation shall be set by the Executive Board, at their regularly scheduled Executive Board Meeting in January, for the Local Publications yearly expenses. (01/31/04)

ARTICLE 11
DUTIES OF THE EXECUTIVE BOARD

SECTION 1.  The Executive Board shall meet at least once a month and special meetings may be called by the President or upon demand by a majority of the Executive Board. Executive Board meetings shall be held at a time that requires the least amount of lost time by the Local Union.

SECTION 2.  The duties of the Local Union Executive Board shall be as prescribed by the International Constitution and such others as are prescribed by these by-laws, but shall not be inconsistent with said International Constitution.

SECTION 3.  The Local Union Executive Board shall have the authority to make disbursements of Local Union funds, but not to exceed two hundred ($200.00) dollars in any single disbursement. Each disbursement must be reported to the next membership meeting. The Executive Board shall have the authority to direct payment of all ordinary bills and expenditures and expenses of the Local Union.

SECTION 4.  Minutes shall be taken of all Executive Board meetings by the Recording Secretary and said minutes shall be read at the next regular membership meeting.

SECTION 5.  A simple majority of the Local Union Executive Board shall constitute a quorum.

SECTION 6.  Each Local Union shall have the following Executive Officers: President, Vice President(s), Recording Secretary, Financial Secretary, Treasurer, three (3) Trustees, Sergeant-at-Arms and Guide. Should one or more of these officers be absent, the absent officer(s) shall be temporarily replaced by the next officer present, following the above order of hierarchy. (01/31/04)

SECTION 7.  No action taken by the Executive Board shall be considered secret or private. 

SECTION 8.  The Executive Board shall serve as the Board of Directors of the Local Union Building Corporation.

SECTION 9.  Any Executive Board member found in violation of Article 32, Section 1 shall relinquish the right to hold office until the next Triennial Election of Officers.  (04/27/85)

ARTICLE 12
DUTIES OF THE PRESIDENT

SECTION 1.  The President shall perform such duties as are outlined under the International Constitution, such other duties as befits the position of President, and shall report the inefficiency of any committee to the membership.

SECTION 2.  The President shall report decisions and actions to the Executive Board, which may accept them or reject them. The President may appeal to the membership any adverse decisions rendered by the Local Union Executive Board.

SECTION 3.  The President of the Local Union is the highest Executive Officer of the Local Union and may not be precluded from major negotiations with plant management, etc., and does not need the invitation of the Plant Chairman to sit in on a meeting. This does not include the grievance procedure meetings, where it is stipulated in the agreement that these meetings will be handled by the Plant Chairman.

SECTION 4.  The President shall appoint the chairpersons of the standing committees except however the Plant Bargaining Committee, the Election Committee, or any Trial Committee.

SECTION 5.  The Local Union President or designee shall serve as a member of the governing board of the Local Union Retired Workers Chapter, with voice and vote.

SECTION 6.  In the event of a medical leave or incapacitation of the Recording Secretary, the President may appoint a member of the Executive Board or an elected officer to do the Recording Secretary’s duties until the medical leave or incapacitation is over.  (10/29/83)

ARTICLE 13
DUTIES OF THE VICE-PRESIDENT

SECTION 1.  The Vice-President shall perform duties as outlined in the International Constitution.

SECTION 2.  In the event of the absence of the President, in excess of eight (8) hours, the Vice-President shall be excused from his regular job and assume the duties of President.

ARTICLE 14
DUTIES OF THE RECORDING SECRETARY

SECTION 1.  The Recording Secretary shall perform duties as outlined in the International Constitution.

SECTION 2.  The Recording Secretary shall maintain in the files, all copies of all regular membership, special membership, regular Executive Board and all special Executive Board meetings. He/She shall submit copies of all minutes to the President and Financial Secretary/Treasurer.

SECTION 3.  The Recording Secretary shall keep on record the results of all Local Union elections.

SECTION 4.  The Recording Secretary shall notify all Executive Board members by mail or email of the date, time and place of all Executive Board meetings. (10/27/07)

SECTION 5.  The Recording Secretary shall report to the membership, any member holding office that does not fulfill the attendance requirements of Article 32, Sections 1 and 2. The member in violation shall be notified in writing one (1) week prior to the report.  (04/27/85)

SECTION 6.  The Recording Secretary shall be responsible for the posting of all notices which do not pertain directly to the duties of other officers or committees on the union bulletin boards in the plant. (10/27/07)

ARTICLE 15
DUTIES OF THE FINANCIAL SECRETARY/TREASURER

SECTION 1.  The Financial Secretary/Treasurer shall perform such duties as set forth in the International Constitution.

SECTION 2.  The Financial Secretary/Treasurer shall make a request to the President, subject to the approval of the Executive Board, for additional clerical help, when it is deemed necessary by him.

SECTION 3.  The Financial Secretary/Treasurer shall not sub-lease his work to any other party unless he becomes incapacitated.

SECTION 4.  In the event of partial incapacitation of the Financial Secretary/Treasurer, whereby he would be unable to continue his work, the Chairman of the Trustees shall fulfill his obligations until such time as he feels he may be able to resume his duties. (10/27/07)

SECTION 5.  The Financial Secretary/Treasurer shall write all checks drawn on Local Union funds and report every month at the regular membership meeting. Copies of this are to be made and issued at each membership meeting.

SECTION 6.  A Certified Public Accountant shall be retained by the Local Union on a yearly basis. The Certified Public Accountant will serve only as a consultant to the Financial Secretary/Treasurer throughout the year regarding, whatever changes may occur in state and federal taxes, and the laws pertaining to these changes. The Certified Public Accountant will assist the Financial Secretary/Treasurer in preparing the year-end reports or whatever the membership deems necessary, pursuant to Section 4.

SECTION 7.  The Financial Secretary/Treasurer is also required to maintain a payroll ledger.

ARTICLE 16
DUTIES OF THE SERGEANT-AT-ARMS

SECTION 1.  The duties of the Sergeant-At-Arms shall be as outlined in the International Constitution.

SECTION 2.  The Sergeant-At-Arms shall have the privilege to appoint deputies at anytime to help preserve order.

ARTICLE 17
DUTIES OF THE GUIDE

SECTION 1.  The duties of the Guide shall be as outlined in the International Constitution.

SECTION 2.  The Guide shall see that the American Flag is on display at all meetings and in a presentable condition.

ARTICLE 18
DUTIES OF THE TRUSTEES

SECTION 1.  The duties of the Trustees shall be outlined in the International Constitution.

SECTION 2.  The Trustee receiving the highest vote in the general election shall be Chairperson.

SECTION 3.  The Chairman of the Trustees shall assume the duties of the Financial Secretary/Treasurer when on vacation or partial incapacitation occurs until such time he’s able to resume his duties.

SECTION 4.  In the event of a long period medical leave or incapacitation of the Chairman of the Trustees, the Trustee receiving the highest vote shall assume the position of Chairman, until his/her return. (10/29/83)

ARTICLE 19
DUTIES OF THE PLANT CHAIRMAN

SECTION 1.  The Saline Ford Plant Chairman shall be responsible for the proper functioning of the In-Plant Committee. This shall include the assignment of all the Committee to the shift and areas in such a manner consistent to the best interests of this Local Union.  (04/25/92)

SECTION 2.  The Saline Ford Plant Chairman shall assist the other Committeemen in their respective duties.  (04/25/92)

SECTION 3.  In the event of the absence of the Saline Ford Plant Chairman, for a period of over eight (8) hours, the member of the Bargaining Committee who received the highest number of votes shall automatically be considered Saline Ford Plant Chairman, for this period of time. In the event all or part of the members of the Bargaining Committee is absent; the same procedure shall be followed on the District Committee list.  (04/25/92)

SECTION 4.  The Saline Ford Plant Chairman with the Bargaining Committee shall meet bi-annually, with the President of the Local Union and exchange opinions, relative to Local Union plant functions. (04/25/92)

SECTION 5.  The Saline Ford Plant Chairman shall use the Alternate Committee. The Saline Ford Plant Chairman may appoint anyone on a daily basis, when the Alternates are being used, or have refused full time assignment. Any Alternate Committeeman refusing full time assignment shall relinquish the right to serve as a Committeeman, in any capacity until the regular triennial election.  (04/25/92)

SECTION 6.  In the event the Alternate Committee list is exhausted, this Local Union shall conduct another election for the Alternate Committeemen. The Saline Ford Plant Chairman shall have the authority to appoint full time Committeemen on a temporary basis, until such election is held and newly elected committeemen are sworn into office.  (04/25/92)

SECTION 7.  In the event of a vacancy or vacancies existing from a resignation or a long term medical leave, or incapacitation of a Bargaining Committeeman, the District Committeeman receiving the highest vote shall assume the position of Bargaining Committeeman. When the medical leave expires and upon the return of the Bargaining Committeeman, he shall assume regular duties on the Bargaining Committee.

SECTION 8.  Any In-Plant Committee member, including full time appointed Representatives and their alternates, found in violation of Article 32, Section 2, of our Local Union By-Laws, shall relinquish the right to hold office until the next triennial election of officers. (06/05/99)

SECTION 9.  Duties of the Total Fitness Concepts Chairman are to represent that unit.  (04/25/92)

ARTICLE 20
OFFICERS: FULL AND PART TIME

SECTION 1.  The President’s office shall become full-time; at the time the membership reaches 1001, based on the Per Capita Tax statements of the previous month, and shall be compensated as set forth in these By-laws.

SECTION 2.  The President’s office shall become part-time; at the time the membership reaches 901, based on the Per Capita Tax statements of the previous month, and shall be compensated as set forth in these By-laws.

SECTION 3.  The Financial Secretary/Treasurer’s office shall become full-time; at the time the membership reaches 1001, based on the Per Capita Tax statements of the previous month, and shall be compensated as set forth in these By-laws.

SECTION 4.  The Financial Secretary/Treasurer’s office shall become part-time; at the time the membership reaches 901, based on the Per Capita Tax statements of the previous month, and shall be compensated as set forth in these By-laws.

SECTION 5.  No other office shall become a full-time office until such time as the membership of this Local Union directs the Constitution and By-Laws Committee to amend or change the appropriate Articles and Sections of these By-laws.

ARTICLE 21
LOST TIME AND EXPENSES

SECTION 1.  The Local Union shall pay a representative or member lost time only, when that representative or member is performing necessary duties, for and on behalf of the Local Union, during the time for which he/she would otherwise be compensated by their employer. The amount of lost time should never exceed the amount which the Local Union representative or member would otherwise have received, from his/her employer for the same period of time, for which he/she is being compensated by the Local Union. Lost overtime premium shall be paid for actual overtime hours worked in the plant, to include shift premium, if applicable. (09/29/01)

A. At no time shall a member receiving lost time from the Local Union, go back into the plant and work those hours, for which they have already been compensated for under lost time. Article 21, Section 1, Subsection A., does not apply to vacations.

SECTION 2.  Any member traveling for Local Union business, not attributable to the duties of an officer, shall be compensated at the rate that is comparable to that paid by the International Union, in excess of 100 miles but not to exceed 300 miles from the Local Union headquarters. The actual cost of airfare NOT to exceed coach fare, or not to exceed the IRS approved rate per mile, whichever is more economical, plus travel expense from airport to final destination. Expense for transportation is to be paid for the actual mode of transportation used. Mileage expense can only be paid to the driver of the automobile. (01/31/04) Exception: Any member traveling for mandatory Local Union business shall receive round trip mileage from the Local Union Hall at the IRS approved rate per mile and parking expenses. In addition, if the mandatory Union business does not exceed four (4) hours, the member will be paid for actual expenses incurred, not to exceed fifteen ($15.00) dollars or thirty ($30.00) dollars for business requiring eight (8) or more hours, for meals. Mandatory Local Union business must be justified by a call letter or official notice from International, UAW and/or Region 1A. (04/30/05)

A. If the mode of transportation is driving, the reimbursement will be actual round trip mileage at the IEB Policy allowance rate, NOT to exceed the equivalent average coach airfare based on a 14-day advance ticket purchase. (03/27/93)

B. Actual cost of parking at the departure airport. The parking facility must be a union represented organization, in order to receive reimbursement.  (06/03/95)

C. Any member traveling to and from Black Lake will receive round trip mileage from the Local Union Hall at the IRS approved rate per mile and per diem, to be paid to the driver only. Those members not driving will receive only Per Diem. (10/27/07)

SECTION 3.  When a member is required by the Local Union to perform services for the Local Union, away from home where it is required to stay overnight, the member shall be allowed single room occupancy rate, or half a double room rate if shared with another member. In addition, the member shall receive the amount set by the IRS, not to exceed the International rate, per day for meals.   (10/28/00)

A. All members receiving travel pay and accommodations will furnish this Local Union with all receipts from such expenditures. (11/23/85)

B. Any member who fails to furnish receipts or fails to reimburse the Local Union for overpayment on expenses from previous travel will not be issued any more expense or travel money until the discrepancies are corrected. Exception: If you are traveling on consecutive weeks, you must turn in all required receipts and/or overpayment at the end of the weeks of consecutive travel before anymore expense or travel money is issued.  (03/26/88)

SECTION 4.  When a member is required by the Local Union to perform services for the Local Union away from home, and overnight stay is not required, and travel is less than 100 miles, daily per diem is not permissible. Expense monies may only be paid for actual expenses incurred. If travel is in excess of 100 miles and overnight stay is not required, it is permissible to pay the fifteen ($15.00) dollars. SECTION 5.  No meal allotment shall be paid for members working at the Local Union Hall.

SECTION 6.  No lost time or expenses will be paid, until a properly executed lost time and expenses voucher is turned in to the Financial Secretary/Treasurer.

SECTION 7.  During the absence of more than one (1) day of the President, the Vice-President shall be authorized to perform the duties of the President.

SECTION 8.  During the absence of more than one (1) day of the Financial Secretary/Treasurer, the Chairman of the Trustees shall be authorized to perform such duties, as are necessary for the ordinary business of this Local Union.

SECTION 9. No committee shall be granted lost time expense for committee meetings, on a regular basis. Any committee requiring lost time expenditures from this Local Union must have prior approval of the President.

SECTION 10. The President shall be allowed to authorize travel expenses, for Union related conferences and meetings, which deviate from the guidelines in Sections 1-4 of this Article, provided that there is a net savings to the Local Union, and that it doesn’t exceed the expense amount approved by the membership. SECTION 11. The Building Chair shall be released up to sixteen (16) hours monthly, in order to perform necessary maintenance on the building. (01/31/04)

SECTION 12. Any member who attends an I.L.I.R. Conference must attend all scheduled sessions in order to be eligible for lost time. Lost time shall be paid on the basis of four (4) hours allowable for each day (excluding weekends) at their regular hourly rate, plus shift premium pay, if applicable.   (01/31/04)

A.      Any member who wishes to attend an I.L.I.R Conference must have attended two (2) out of the last three (3) General Membership Meetings. At least one (1) member will make a written or oral report to the membership at the next membership meeting.  (01/31/04)

SECTION 13. Any member who agrees to attend a scheduled event, which requires the Local Union to pay a registration fee, is assumed committed to attending. In the event the member must cancel, they are required to give the President five (5) working days notice, unless the cancellation is due to a death or incapacitation of an immediate family member or incapacitation of the member. The member will be required to reimburse the Local Union, the amount of any travel expenses advanced, and the lost registration fee shall be reimbursed, if a replacement is not found.  (01/31/04)

ARTICLE 22
CONVENTIONS

SECTION 1.  The Local Union shall participate in the ‘Constitutional Convention’ of the UAW, as prescribed in the International Constitution, county council conventions. (per International 03/17/99)

SECTION 2.  The Local Union shall elect and send to all conventions, at least the minimum number of delegates able to carry the maximum voting power, of the Local Union allotted by the convention call.

SECTION 3.  All elected convention delegates shall meet and comply with the requirements, set forth in the International Constitutional and Local Union by-laws.

SECTION 4.  Only those elected, as delegates shall be sent to conventions, unless it becomes necessary to substitute alternates. Alternates shall be sent only when substituting for regular delegates.

SECTION 5.  Delegates to the Skilled Trades Convention will be chosen in accordance with the call letter for each of these conventions. The regular delegate will be the Skilled Trades Bargaining Committeeperson. The additional delegate will be of the Maintenance or Tool and Die Trades, depending on the call letter and the classifications of the regular delegate.     (10/29/94)  

ARTICLE 23
STANDING COMMITTEES

SECTION 1.  The Local Union shall have the following standing committees:

Constitution & By-Laws, Union Label, Education, Conservation & Recreation, Community Services, Civil and Human Rights, Citizenship & Legislative, Consumer Affairs, Women’s, Veteran’s, plus:

SECTION 2.  No member shall serve on more than two (2) standing committees.

SECTION 3.  All income and expenditures of any standing committee shall be itemized and presented to the Financial Secretary/Treasurer, by Monday on the last week of the month.

A.    All committee expenditures must have prior approval of the membership. 

B. All committee fund raising ventures must have prior approval of the membership, and must be designated as being sponsored by the Local Union.

SECTION 4.  A report of all activities and proposed activities of each standing committee shall be reported to the membership.

SECTION 5.  A member appointed to a standing committee must have at least six (6) months continuous good standing with the Local Union, prior to the appointment.

SECTION 6.  The Resolutions Committee consisting of three (3) members shall accept and assemble written resolutions, to be presented to the Bargaining Committee, prior to Local agreement negotiations.

ARTICLE 24
COUNCIL DELEGATES AND REPRESENTATIVES

SECTION 1. All delegates to county councils shall be appointed by the President with approval of the Executive Board.

SECTION 2.  Delegates to the National Ford Council, with the exception of the President and Plant Chairman, shall be elected by the membership at a General Membership meeting. The President and the Saline Ford Plant Chairman shall be delegates to the National Ford Council by virtue of holding their respective offices.  (10/28/95)

A. Delegates to Sub-Council #6 will be the President, the Saline Ford Plant Chairman and the Bargaining Committee. The Bargaining Committeeperson, which received the most votes, shall be the third delegate, the other Bargaining Committeeperson shall be the fourth delegate, and alternate delegates shall be the Officer that would replace the delegate, should the delegate be absent from work. “Provided that such selection shall at all times conform to the language promulgated by National Ford Council by-laws.” (01/27/96)

B. Delegates to Sub-Council #6, with the exception of the President and the Saline Ford Plant Chairman shall be production workers. “Provided that such selection shall at all times conform to the language promulgated by National Ford Council by-laws.”   (01/27/96)

C. Delegates and Alternates shall be elected separately. The number of elected delegates and alternates shall be determined by the National Ford Council by-laws, and the plant population, “Provided that such selection shall at all times conform to the language promulgated by National Ford Council by-laws.”  (04/25/98)

SECTION 3.  Delegates to Sub-Council #3 must be bona-fide Skilled Tradesmen. Number of delegates will be determined by the by-laws of Sub- Council #3. Delegate(s) will be voted for by Skilled Trades at the General Election.

A. The Skilled Trades Bargaining Committeeman will automatically be a regular delegate to Sub #3. The Skilled Trades District Committeeman will be a fraternal delegate.  (03/26/94)

SECTION 4.  Attendance at Leadership Institutes Classes shall be determined by the quotas set forth in the Official Call letters. The number of officers to be sent shall be determined by the Local Union President, if there are sufficient funds available.

A. No officer shall return for any Leadership Institute Classes until every officer has had the opportunity to attend. Upon availability of extra openings, the President shall set up a procedure by which rank and file members may fill the quota. (06/24/89)

ARTICLE 25
MUTUAL AGREEMENTS

SECTION 1.  All written mutual agreements of a permanent nature, entered into between Local 892, UAW and the Ford Motor Company, shall NOT become effective until ratified by the membership.

A.      All written mutual agreements of a permanent nature, entered into between Local 892, UAW and Total Fitness Concepts, shall NOT become effective until ratified by the membership.  (04/25/92)

SECTION 2.  Issues pertaining solely to Skilled Trades shall be voted on by Skilled Trades members only, except matters pertaining to Local Union funds, which must be voted on by the entire membership present and voting.

SECTION 3.  Issues pertaining solely to production shall be voted on by production workers only, except matters pertaining to Local Union funds, which must be voted on by the membership present and voting.

SECTION 4.  One (1) copy of all written mutual agreements entered into between Local 892, UAW and the Ford Motor Company shall be on file with the Recording Secretary, and one (1) copy at the Local Union headquarters. These copies shall become the permanent records of Local 892, UAW. (04/25/92)

ARTICLE 26
ELECTIONS, VACANCIES AND ELIGIBILITY

SECTION 1.  The Election Committee shall be elected at the regular membership meeting in February, the year of our regular triennial election of officers, by the members of Local 892, UAW. Nominations shall be held the third week of April and the election of officers shall be held the third week of May, of the same year. Installation of officers shall take place at the regular membership meeting following the election.  (08/24/91)

SECTION 2.  The President shall appoint a committee of five (5) members to conduct the election of the Election Committee. 

SECTION 3.  The Election Committee shall consist of: nine (9) permanent members, and (9) alternates. The member receiving the highest number of votes will assume the duties of Chairman. The next two (2) members receiving the next highest number of votes will be co-chairpersons, and the next six (6) in order received will become permanent members. The next nine (9) will become alternates, and may be used to increase the size of the committee as required. The Chairman of the Election Committee will recommend the number of persons to serve on the Election Committee. When voting for the Election Committee, you will vote for nine (9) members. (01/30/88)

A.    If the full complement of Election Committee members is not elected, the Chairman shall have the authority to appoint members for such. Subsequent to approval of the membership at the March meeting.                                                        

B.      If a person does not wish to be Chairman or Co-Chairman, they fall to the bottom of the list of permanent members. This must be done at the same meeting. (01/30/88)

SECTION 4.  The Election Committee shall adopt such safeguards, as are necessary to ensure a fair election, supervise the balloting, tabulation & certification of all Local Union elections.

SECTION 5.  The Election Committee shall be responsible to the Local Union membership.

SECTION 6.  The Election Committee shall not be interfered with by any officer, or by the Executive Board, or by any other division of the Local Union.

SECTION 7.  Members of the Election Committee shall not participate in any campaigning or criticism of the candidates, at any time on the day or days of the election.

SECTION 8. There will be no consuming of alcoholic beverages by the Election Committee, on the day or days of the election.

SECTION 9. Voting machines will be used for the regular triennial election.

A. If voting machines are not available, Certified Public Accountants will be used in the regular triennial elections.

            B. The Election Committee will handle all other elections.

SECTION 10. This Local Union shall during the election(s) of Executive Officers and Constitution Convention delegates, use the procedure for absentee balloting as set forth in the Constitution of the International Union, UAW, as found within the section of Interpretations of the Constitution, Article 38, Section 10(b).  (10/19/84)

SECTION 11. Candidates may designate challengers to observe the election and tabulation of the ballots. Such challengers must have written authorization from the candidate, and such authorization must be presented to the Election Committee Chairman, one (1) week prior to the election.

SECTION 12. Skilled Trades ballots will be a different color than that for production workers, for ratification and contractual issue votes, or in elections where the office(s) to be elected would require a separate ballot. (04/27/85)

SECTION 13. Total Fitness Concepts election(s) are to be held using paper ballots. (04/25/92)

SECTION 14. No member shall be eligible for election to a non-executive office of Local 892, UAW, unless he/she shall have been a member of Local 892, UAW in continuous good standing for one (1) year prior to the first day of nominations.

SECTION 15. If an Officer of Local 892, UAW holding any elected office, the term of which is not expiring, desires to become a candidate for another elected position, he/she shall be obligated to resign his/her present office, in writing, in advance of accepting a nomination to run for the office being filled. A. All appointed representatives by the National Ford Department, at the Local Union level, shall be obligated to submit a written resignation, in advance of the acceptance of a nomination for a Local Union elected office. (10/29/94)

SECTION 16. No member is eligible to serve as a delegate from this Local Union unless he/she has been in continuous good standing in the UAW for twelve (12) months, immediately preceding the first day of the month, in which the convention is held, and shall also have been a member of the Local Union for three (3) months immediately preceding the first day of the month, in which the convention is held. Members must pay their dues or secure out of work receipts, in accordance with provisions of the International Constitution.

SECTION 17.   The election of Local Union Officers shall be covered, set forth in Articles 38 and 45 of the International Constitution. (04/25/92)

SECTION 18. All Local Union Officers shall be elected for the term of three (3) years.

SECTION 19. Plant employment by virtue of the contract, shall pre-determine the number of full time District Committee representatives to be elected at the time of nominations.  (01/26/91)

A.  A total of ten (10) alternate production committee representatives shall be elected at each triennial election. Any additional production district committee representatives needed, due to increase of Ford unit population, shall be taken from the elected alternate district committee, in the order of the votes they receive in the election, with the person who received the most votes ascending first, and so on.

Due to fluctuations in employment necessitating the removal of full time representatives, the production district committeeman receiving the least number of votes, shall be taken off first. Those committeemen assume position at the top of the alternate committee, and shall be returned in reverse order, from which they were taken off.  (10/29/94)

B.      At the time the Skilled Trades complement reaches the contractual allotment plus100, a Skilled Trades representative shall become part of the District Committee. Due to fluctuations in employment, necessitating the removal of full time representatives, when the Skilled Trades employment drops below the contractual allotment plus 100, the Skilled Trades District shall assume the position of number one Skilled Trades Alternate. The person elected to this position shall assume the responsibilities of the Skilled Trades Chairman.  (03/26/94)

SECTION 20. Candidates for non-Executive offices and Convention delegates shall be elected by plurality vote, including the Plant Chairman.

SECTION 21. All elections will be held at the Local Union headquarters.  (10/27/07)

SECTION 22. Acceptance of Nominations must be presented to the Election Committee, in writing.

SECTION 23. Polls will be open for the regular triennial and run-off election for one (1) day, from 5:00 A.M. until 9:00 P.M.

SECTION 24. There will be no campaigning within fifty (50) feet of the election polls.

SECTION 25. A candidate for an uncontested office shall be declared elected, but the ballots for that office will be counted and results posted.

SECTION 26. For the purpose of breaking a tie, this procedure will be followed:

          1. Plant seniority or Date of Entry for Skilled Trades (01/26/91)

          2. Company seniority.

          3. Alphabetically from A to Z.

SECTION 27. Results of the election will be posted in the plant immediately after the counting by the election committee.  (10/27/07)

SECTION 28.   In the event a candidate petitions for a recount, such request must be in conformity with the International Constitution.

SECTION 29. The Saline Ford Plant Chairman shall use the alternate committee. The Saline Ford Plant Chairman may appoint anyone on a daily basis, when all the alternates are being used or have refused full time assignment. Any Alternate committeeman refusing shall relinquish the right to serve in any capacity until the regular triennial election. (04/25/92)

SECTION 30. In the event the alternate committee list is exhausted, this Local Union shall conduct another election, for the alternate committeemen. The Saline Ford Plant Chairman shall have authority to appoint full time committee on a temporary basis, until such election is held and newly elected committeemen are sworn into office.  (04/25/92)

SECTION 31. All Local Union officers, committees and other members handling funds and other property of the Local Union shall, at the completion of their duties, turn over all papers, documents, funds and/or other Local Union property to the newly elected Local Union officers. (09/30/06)

 ARTICLE 27
DUES, RE-ADMISSION AND INITIATION FEES

SECTION 1. Re-admission and initiation fees shall be uniformly set at thirty-five dollars ($35.00) and shall be payable in accordance with the time limit set forth in the contract, between the International Union, UAW and the Ford Motor Company. (02/26/00)

A.    Withdrawal slips must be turned in to the Financial Secretary/Treasurer’s office within thirty (30) days after hire in.

B. Five ($5.00) dollars of each initiation dues collected shall be allocated to the New Member Orientation Fund. (03/29/03)

             SECTION 2. Dues will be collected in accordance with Article 16, Section 2 of the International Constitution, UAW.  (10/19/84)

ARTICLE 28
STRIKES

SECTION 1.  Authorization and/or any other points related to strikes or work stoppage shall be governed as outlined in the International Constitution and the Master Agreement, between the UAW and the Ford Motor Company.

ARTICLE 29
AMENDMENTS TO THE BY-LAWS

             SECTION 1. These by-laws may be amended by presenting a motion in writing, setting forth the amendments   brought to a membership meeting. The motion shall be read at that meeting and referred to the Constitution

and By-Laws Committee, which will report to the succeeding meeting. The posted agenda must contain a notice of the particular by-laws amendment that will be considered. If approved by two-thirds (2/3) of the membership voting, at this succeeding meeting, the amendment shall be considered adopted by the membership.

SECTION 2. These By-Laws of the Local Union shall at all times be subordinate and subject to the provisions of the Constitution of the International Union, UAW. As such Constitution now exists or may from time to time, hereafter, be altered or amended. In the event of any conflict, the Constitution or the International Union, UAW shall govern.

SECTION 3. The Constitution and By-Laws Committee shall meet three (3) times a year, to review and evaluate the Local Union By-Laws.  (04/25/98)

SECTION 4.  All new by-laws and amended by-laws shall be printed after being reviewed by the Constitution and By-Laws Committee, following each Constitutional Convention. The date of the new or amended by-law shall be added.

ARTICLE 30
RETIREES

SECTION 1.  The rules governing retirees shall be set forth as outlined in the International Constitution.

ARTICLE 31
COMPENSATION OF OFFICERS AND OTHERS

SECTION 1.  Any member authorized to perform a service under the direction of this Local Union shall be paid an amount equal to lost time at his regular hourly rate, plus bonus payments, profit sharing and all economic gains and benefits covered under the UAW-Ford Collective Bargaining Agreement, less any compensation received, for the same hours worked from the company.  (03/27/99)

SECTION 2.  Compensation of full time officers for duties, attributable to their office shall be as follows:

SECTION 3.  Any alternate, part-time officer or committeeman assuming the duties of another officer shall receive compensation of the office, for the pro-rated time served in said office.   (03/05/86)

A. All full time appointed officers (by National Ford Department, or Local 892 shall be compensated fifty dollars ($50.00) per month for duties attributable to their office. (05/30/98)

SECTION 4.  At the time the membership reaches 1001, based on the Per Capita Tax statements of the previous month, compensation of officers for duties attributed to the offices shall be set forth in these by-laws, to begin the first day of the month, following the Per Capita Tax statement.

A. At the time the membership drops below 901, based on the Per Capita tax statements of the previous month, monthly officer allowance(s), shall be one-half (1/2) the amount set forth in these by-laws, to begin with the first day of the month following the Per Capita tax statement.

SECTION 5. The President shall be compensated for full time employment, at the rate of a Die Cast Die Maker Leader for a minimum of forty (40) hours per week, including cost of living, number one (#1) shift premium, bonus payments, profit sharing, less any compensation received, for the same hours worked from the company. And an equal share of overtime as allotted to the full time appointed officers, not to exceed the UAW-Ford contractual, forced overtime provision and all other economics gains and benefits covered under the UAW-Ford Collective Bargaining Agreement.      (03/27/99)

A. The Saline Ford Plant Chairman shall receive the difference between his rate of pay and that of a Die Cast Die Maker Leader, while on full time per forty (40) hour week, including cost of living, number one (#1) shift premium, bonus payment, profit sharing, and all economic gains and benefits covered under the UAW-Ford Collective Bargaining Agreement, less any compensation received for the same hours worked, from the company. The Saline Ford Plant Chairman may not use this compensation as a make-up of personal time off. (03/27/99)

B.      At such time as the President’s office becomes part-time, both the President and Saline Ford Plant Chairman shall receive their regular hourly rate.  (04/25/92)

SECTION 6.  The Financial Secretary/Treasurer shall be compensated for full time employment at the rate of a Die Cast Die Maker Leader times forty (40) hours per week, including cost of living, number one (#1) shift premium, bonus payments, profit sharing and all economic gains and benefits covered under the Ford-UAW Collective Bargaining Agreement, less any compensation received, for the same hours worked from the company. The Financial Secretary/Treasurer shall be compensated for lost overtime premium as outlined in Article 21, section 1 of these By Laws. (09/29/01)

A. The Financial Secretary/Treasurer when on part-time shall be compensated for lost time at the negotiated hourly rate of his last classification held. (04/30/05)

SECTION 7.  It shall be understood that any member, active or retired, being elected for any full time office shall be compensated at the rate of pay set forth in these by-laws, and in compliance of Article 31, sections 5 & 6 of these bylaws, regardless of what their rate of pay is while working in the plant or receiving a pension from the company. SECTION 8.   Any member assuming the duties of a full time officer that has been excused for three (3) or more consecutive days will receive the salary of that office.  (02/24/99)

SECTION 9.  Each elected officer and appointed officer will receive an allotment for officer shirts and/or jackets and hats. The allotment amounts will be set forth at the membership meeting, after the installation ceremony.  These garments must be union and/or American made. (09/30/06)

A.    Items must be printed with the UAW Logo and Local 892. They may also include name and position.

ARTICLE 32
ATTENDANCE RULES

SECTION 1.  All Executive Board officers must attend two (2) out of every three (3)-membership meetings, and two (2) out of every three (3) Executive Board meetings, unless properly excused by the President, subject to approval of the Executive Board, in order to continue to hold their respective office. SECTION 2.  All other elected and full time appointed officers must attend two (2) out of every three (3) consecutive membership meetings, unless properly excused by the Saline Ford Plant Chairman, subject to the approval of the Executive Board, in order to hold their respective office or position. (04/25/92)

SECTION 3.  Death or sickness in the family, jury duty, union business, military duty, personal leave of absence, medical leave of absence, vacation or working in the plant constitute valid excuses. All excuses must be submitted in writing and validated by the proper executor, within three (3) business days following the meeting. Any officer may appeal an adverse decision of the Executive Board, to the membership for reconsideration.           (10/27/07)

SECTION 4.  Failure to comply with the above attendance rules shall result in automatic removal from their respective office or position, and they shall not be permitted to run for any elective office for the balance of the term of office from which they were removed, except as a delegate to the International Constitutional Convention. SECTION 5.  Any member of Local 892, UAW, desiring a donation or representing a group, which is seeking a donation, shall attend at least two (2) of the three (3) general membership meetings, immediately prior to the meeting, in which a donation is being considered. (04/25/98)

A. Any donations made by Local 892 to charitable or community organizations, shall not exceed one hundred- fifty dollars ($150.00) per request, per calendar year, per organization. Above-mentioned organizations must be union affiliated. (02/26/00)

ARTICLE 33
PETITIONS AND RECALL

SECTION 1.  Any petition to request recall procedure of a committeeman must be signed by fifty percent (50%) of the members in that committeeman’s area.

SECTION 2.  A quorum requirement for a recall meeting shall be fifty percent (50%) of the members represented by the petitioned committeeman, and two-thirds (2/3) majority of those present and voting, shall be required to recall the said committeeman, in accordance with the International Constitution as it stands or may be amended.

ARTICLE 34
DEATH POLICY

SECTION 1.  In the case of a death of a member or a retiree of this Local Union, a Bible shall be given. Also, a Bible shall be given to a member, upon application, who has lost a loved one and qualifies for bereavement pay through the company.

ARTICLE 35
LEASES AND LONG-TERM AGREEMENT

SECTION 1.  No agent or official of this Local Union is authorized to execute a real estate lease, deed, service or maintenance contract or other long term agreement, unless proposed agreement has been viewed by an outside expert or attorney, and approved by the Local Union Executive Board.
